Terms of Use

By downloading, installing, or using CaloWise ("the app"), you agree to these Terms of Use. If you do not agree, do not use the app. These Terms form a legally binding agreement between you and CaloWise.

1. The service

CaloWise is an iOS application that provides:

AI-powered food recognition from photos (camera and gallery)
Nutrition label scanning with automatic nutrient extraction
Barcode scanning with product lookup via Open Food Facts
AI text-based meal description analysis
Calorie and macronutrient tracking
Personalised nutrition plans and progress tracking
Integration with Apple Health (optional)

AI analysis (food photos, nutrition labels, text descriptions) is performed by AI, accessed via our secure Firebase backend. Barcode lookups use the Open Food Facts public database and do not involve AI.

The app is designed for informational and educational purposes only.

2. Not medical advice

CaloWise is not a medical device and does not provide medical advice. Calorie and nutrition estimates are approximations generated by AI and should not be relied upon for medical decisions. Barcode product data is sourced from Open Food Facts, a community-maintained database, and may not always be complete or accurate.

Always consult a qualified healthcare professional before starting any diet or making significant changes to your eating habits, particularly if you have a medical condition, are pregnant or nursing, or have a history of disordered eating.

3. Account and eligibility

You must be at least 13 years old (16 in the EEA) to use CaloWise.
You must provide accurate information when creating an account.
You are responsible for maintaining the security of your account credentials.
You may only hold one account per person.

4. Subscriptions and payments

CaloWise requires an active CaloWise Premium subscription to access core features.

Subscriptions are billed annually through your Apple ID via the Apple App Store.
A free trial may be offered at sign-up. If you do not cancel before the trial ends, you will be charged the subscription price. Only one free trial is available per Apple ID.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
You can manage and cancel your subscription from Settings → [your name] → Subscriptions on your iPhone.
Subscription management and entitlement validation is handled by RevenueCat on our behalf. We do not store or process payment card details directly.
Refunds are subject to Apple's App Store refund policy. We do not issue refunds directly.
If you reinstall the app or use a new device, use "Restore Purchases" in the app to recover your subscription.

5. AI-generated content and accuracy

Nutritional estimates generated by AI are approximations, not exact measurements. You acknowledge that:

Portion size estimation from photos is inherently approximate.
The AI may misidentify foods, especially in complex or mixed dishes.
Nutrition label readings are extracted automatically and should be verified against the physical label for critical dietary needs.

Do not rely solely on CaloWise for dietary decisions that affect your health, particularly if you have conditions requiring precise nutritional control.

6. Acceptable use

You agree not to:

Reverse-engineer, decompile, or attempt to extract source code from the app.
Use the app for unlawful purposes or to harm yourself or others.
Share your account with other people.
Attempt to interfere with the app's security or backend infrastructure.
Submit content that violates third-party intellectual property rights.

7. Intellectual property

CaloWise, its logo, design, and all app content are owned by us and protected by applicable intellectual property laws. The data you create — food logs, weight entries, photos — belongs to you. By submitting content, you grant us a non-exclusive licence to process it solely for providing the service, as described in our Privacy Policy.

8. Third-party services

The app integrates with: Google Sign-In and Apple Sign-In (authentication), Firebase (data storage and backend), AI analysis, Open Food Facts (barcode database), RevenueCat (subscription management), and Apple Health (optional sync). Your use of these services is subject to their own terms and privacy policies.

9. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time from within the app. Active subscriptions must be cancelled separately via your Apple ID settings — account deletion does not automatically cancel them.

10. Disclaimer of warranties

CaloWise is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the app will be uninterrupted, error-free, or that AI estimates will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the app, including any health outcomes resulting from reliance on nutritional estimates. Our total liability shall not exceed the amount you paid for your subscription in the preceding 12 months.

12. Governing law

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law principles. EU residents retain any mandatory consumer protection rights under their local law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated in the app and by updating the date above. Continued use of the app after changes constitutes acceptance.
